Q:    Yesterday you told to the court that you are a clinical specialist of HKL from 2007. What is your nature and scope of your duty as clinical specialist?
A:    My scope of work is basically dealing with surgical disease of the patient starting from the neck until the gluteal area. I am also involved with the management in the surgical department and educating new doctors who have interest to do surgery in the future. I specifically deal with surgical disease which involved many organs which I mentioned yesterday.

Q:     You mentioned about procedure for taking samples yesterday.  You mentioned that appliances should be sterilized. When you examined Saiful at 9.00 p.m. using the protoscope, was it sterilized?
A:     Yes. It has already been sterilized and ready to be used for examination.

Q:     The protoscope, the swabs, the containers. Were they sterilized?
A:     Yes. Already sterilized and they are packed and ready to be used in the room.

Q: When you first examine the peril-anal, the peril-anal region is said to be moist. What could have caused that?
A: There are few possibilities. Any water based material contact may cause that area to be moist and also if there is an examination that was done before that and the examiner using any lubrication that can also cause a moist area.

Q: You said you were informed that Saiful had been examined before.
A: Yes.

MY showed P4 (KY Gel) to the SP2.

Q: Doctor, this is known as KY Gel. Can this be used as lubricant?
A: Yes.

Q: Either in sexual act or during insertion using the protospcope?
A: Yes.

Q:  What was the lubricant you use that day during the examination?
A: I used the lignocine gel as lubrication during the examination.

Q: What is the difference between KY Gel and the gel you used?
A: It has analgesic effect to reduce discomfort on the patient compared to KY Gel.

Q: But both acted as lubricant?
A: Yes.

Q: Did Saiful at any time during the interview when you were present during the exam or afterwards told you or anyone that someone has introduced any plastic object into his anus?
A:     No.

MY: That’s all.

KS: As indicated, we can’t go on with the cross today. Our expert is unable to help us with the cross in the absence of certain documents and materials he needed. In fact we have filed a notice of motion this morning followed by affidavit of AI and Dr. Wells. I would under this circumstance seek an adjournment for these materials to be supplied to us. In fact we have prepared our submission this morning. We are asking this application to be heard before the continued hearing in July.

MY: YA, the Prosecution is objecting to this application. In fact, we are ready with our oral submission. But if YA require proper and written submission, we would agree with our learned friend. In fact, we are served only with unsealed copy of the notice of motion and maybe they have got to refilled. We are not sure under what rules of law they are making this application.

KS:    We would like to make it clear that we are also prepared to go on.  But proper submission is required. No delaying tactics. We are ready to proceed as soon as possible.
YA:    What I said is just a skeleton submission, not the proper submission. Our next hearing date is 14th of July. I’m going to hear the submission before 14th of July.
